Terms & Conditions

The agreement between you and Instant LTD for using Payol, in plain language.

1Who these terms cover

Payol is a product of Instant LTD, a company registered in the Republic of Rwanda, which owns and runs it. These terms are an agreement between you and Instant LTD ("Payol", "we", "us"). They apply to everyone who uses Payol at https://payol.ink and the pages, messages and services that come with it:

  • Account holders ("you"): individuals and businesses who sign up to get paid or to send money.
  • Payers: people who pay through a Payol payment link, invoice or storefront. Payers don't need an account.
  • Recipients: people an account holder pays, by transfer to their mobile money number or through a payout link. Recipients don't need an account either.

By creating an account, or by paying or receiving money through a Payol page, you agree to these terms and to our Privacy Policy. If you don't agree, please don't use Payol.

2Who can open an account

  • You must be at least 18 years old and able to enter into a binding contract.
  • Accounts are for individuals and registered businesses in Rwanda. If you open an account for a business, you confirm that you're allowed to act for it.
  • The information you give us must be true and complete, and you must keep it up to date.
  • Payroll and invoices are for business accounts only. Individual accounts can get paid with payment links and send money by transfer or payout link, and can't use payroll or invoices.

3Your account and sign-in

You sign in with your phone number, email or Google account and confirm with a one-time code. If you add a password, we may still ask for a code on a device we don't recognise. You're responsible for keeping your phone, email and Google account secure, and for everything done through your account.

If you think someone else has access to your account, email [email protected] straight away.

You can invite teammates. Owners and admins can withdraw, refund, send money, change payout accounts and submit activation; members can create payment links and invoices. You're responsible for the people you invite and what they do in your account.

4Activation and identity checks

You can build and preview links and invoices as soon as you sign up. Before your account can take or move money, we need to verify it. Activation covers your business profile, your identity (an ID or passport and a selfie, plus the registration certificate and TIN for a business) and your first payout account.

  • Each time you submit, you confirm that you're the real owner of the account or allowed to act for the business it's for, that what you sent is real and your own, and that the account won't be used for anything these terms don't allow. If that isn't true, for example if you pretend to be another person or business, aren't the real owner or representative, or use the account for something we don't allow, we freeze the account and may close it.
  • We may ask for more information at any time, including after you're approved, to meet our legal obligations or to manage risk.
  • We may approve your account, ask you to change part of what you sent, or refuse it. Where the law stops us, we may not be able to tell you why.
  • The Verified badge on your pages means we've checked who the account belongs to. It isn't an endorsement of what you sell.

5What Payol does, and what it isn't

Payol gives you transfers, payout links and payroll to pay people, payment links, invoices and a storefront to get paid, a wallet that holds your money, and withdrawals to mobile money. Money moves through mobile money networks and our payment partner.

Payol isn't a bank. Your wallet balance isn't a bank deposit and doesn't earn interest. We aren't a party to the sale between you and your customers: the goods or services, their price and their delivery are between you and them.

6Payments you receive

  • A payment counts only once the mobile money network confirms it to us. Until then, it isn't in your wallet.
  • Payers approve each payment on their own phone with their PIN. We never see or store mobile money PINs.
  • If a payment fails or isn't approved in time, no money moves and the payer can try again.
  • A one-time link or an invoice can't be paid twice. If a payer is charged twice by mistake, or pays something that was already paid, we refund the extra payment automatically.
  • Every payment you receive waits as Pending for at least 48 hours before you can withdraw it or send it on, so that a payment a payer disputes can still be returned. We may set a longer hold for your account. Each payment shows the date it becomes available. Money you add to your wallet yourself isn't held.

You're responsible for what you sell and for delivering it, for the information on your pages, for answering your customers, for your own refund policy and for the taxes on your income.

7Fees

  • Signing up is free and there's no monthly fee.
  • We charge fees on incoming payments, withdrawals and disbursements, at the rates on our pricing page. Every account pays the same rates.
  • The fee on a payment comes out of the amount you receive, and each payment shows the amount, the fee and what you keep. The fee on a withdrawal or a disbursement is shown before you confirm and is taken from your Available balance with the amount.
  • Messages we send for you (payment requests and links, payout links, number confirmations, payslips, and team alerts by SMS or WhatsApp) are free up to a monthly allowance per channel, then charged per message at the rates on our pricing page. They are paid from your Available balance before they go out, and a message that fails to send is credited back. Invoices, reminders, receipts and one-time codes are always free.
  • We may change our fees. The fee shown before you confirm is always the fee you pay.
  • Payers' and recipients' own mobile money charges, such as cash-out fees, are set by their network and aren't part of Payol's fees.

8Your wallet

Your wallet has three balances:

  • Available: Yours to send or withdraw now.
  • Pending: Payments on hold until their release date.
  • Reserved: Set aside for payouts on their way or waiting to be claimed, withdrawals and refunds in progress.

Every movement is a line in your wallet. Lines are never edited or deleted; a correction is a new line with its reason. If money reaches your wallet by mistake, we correct it with a new line, and you agree to return any money you weren't entitled to.

9Withdrawals

  • You can withdraw from Available to a payout account you've added. Use only accounts that belong to you or your business.
  • Adding a payout account and each withdrawal need a one-time code sent to your phone or email.
  • A withdrawal is final once the network confirms it. If it fails, the amount and its fee go back to your Available balance.

10Paying people

  • Every payment to people, by transfer, payout link, group payment or payroll run, needs a one-time code. Its amount and fee move to Reserved until it is paid.
  • A transfer goes straight to the mobile money number you send it to. Before you confirm we show the name you saved, whether its owner confirmed the number and, where available, the name the network holds for it. Check it: money sent to a wrong number may not be recoverable. If the network rejects a transfer, the amount and its fee go back to your Available balance.
  • A payout link is claimed by the person it is for: when we have their phone number or email, we send them a code first. Share links only with the people they are for. You can cancel a link until the recipient chooses where to receive the money, and if it expires or you cancel it, the amount and its fee go back to your Available balance.
  • A payroll run is paid only after an owner or admin approves it with a one-time code. Payol pays the amounts you set; taxes and contributions on them remain your responsibility.
  • Once the network confirms a payout, we can't reverse it.
  • Sending payment requests and links for you needs our approval, and we may turn it off, for example to stop unwanted messages.

Recipients: claim, or confirm, only a mobile money number that belongs to you, and check it before you confirm. Money sent to a number you entered by mistake may not be recoverable.

11Refunds

You can refund a payment in full or in part, up to what was paid. The refund goes back to the number that paid and comes out of your Available balance. Payol keeps the fee from the original payment. If a refund fails, the money goes back to your Available balance.

If a payer disputes a payment, or we must refund one, and your Available balance can't cover it, we may pay the refund from our own funds. Once it is sent, we take it from your wallet, and your Available balance can go below zero. What you receive next repays us first, you can't withdraw or send money until your balance is above zero again, and you agree to repay anything still owed when we ask.

12Holds, reviews and closing an account

We may hold money, pause features or put your account on hold if we suspect fraud, a breach of these terms, a security problem or a mistake, or if the law or an authority requires it. While your account is on hold, money can't leave it. We'll tell you what we need, unless the law stops us.

You can close your account by writing to [email protected] after withdrawing your balance. We may close an account that breaks these terms. When an account closes, we pay its Available balance to its payout account, after any checks and minus anything owed (such as refunds, corrections or fees), unless the law requires us to keep it.

13What you can't use Payol for

  • Anything illegal, or selling anything you aren't allowed to sell.
  • Fraud, scams, misleading offers, or pretending to be another person or business.
  • Money laundering, financing terrorism, or getting around sanctions.
  • Collecting money for someone else without their permission, or letting others use your account.
  • Illegal drugs, weapons, counterfeit or stolen goods, unlicensed gambling or lotteries, unlicensed financial services, pyramid schemes, or content that exploits or harms people.
  • Sending links, invoices or messages to people who haven't asked to hear from you.
  • Flooding numbers with payment prompts, testing numbers that aren't yours, or trying to break into or overload Payol.

We may refuse or reverse activity that breaks these rules, and we report suspicious activity to the authorities when the law requires it.

14Messages we send for you

When you ask us to, we send your links, invoices, reminders and receipts to your customers and recipients by SMS, WhatsApp or email under your business name. You confirm that you're allowed to contact them and that what you send is accurate and lawful. Payers and recipients also get receipts from us for the payments they make or receive.

SMS and WhatsApp aren't available yet. Until they are, one-time codes, receipts and notifications go by email, and features that need a text message, such as signing in with a phone number or confirming a number, are turned off.

15Your content and brand

Your business name, logo, images and text stay yours. You let us show them on your pages, invoices, receipts and messages so we can run Payol for you. You must have the right to everything you upload.

16Our brand and software

The Payol name, logo and brand, and the website, apps and software behind Payol, belong to Instant LTD. These terms let you use Payol as they describe, and nothing more: you may not copy, resell or reverse-engineer Payol, or use our name or logo, without our written permission.

17Availability

Payol depends on the mobile money networks, our payment partner and our hosting providers. When one of them is slow or down, payments, payouts and withdrawals may be delayed or unavailable. When a network doesn't answer, we check the status with it before doing anything else, so a lost reply never sends money twice. We don't promise that Payol will always be available or free of errors.

18Liability

As far as the law allows, Payol is provided as it is. We aren't liable for indirect losses such as lost profit or lost business, for what mobile money networks or other third parties do, or for disputes between you and your customers. Our total liability to you is limited to the fees you paid us in the twelve months before the claim.

Nothing in these terms limits liability that can't be limited under the law of the Republic of Rwanda, including for fraud.

19Claims caused by your business

If someone makes a claim against us because of what you sold, what you uploaded or sent, or because you broke these terms or the law, you agree to cover our reasonable costs and losses from that claim.

20Changes to these terms

We may update these terms as Payol changes. We'll tell you by email or in the app before an important change takes effect. If you keep using Payol after that, the new terms apply.

21Law and disputes

These terms are governed by the laws of the Republic of Rwanda. If something goes wrong, write to [email protected] first and we'll try to resolve it with you. If we can't, the competent courts of the Republic of Rwanda will decide.
